Liberty Flights And TRPR (TPD)

Liberty Flights are fully compliant with the Tobacco & Related Products Directive

Since 20th May 2016 e-cigarettes and vape products containing nicotine have been regulated under the Tobacco and Related Product Regulations 2016 (TRPR) which brought the European Tobacco Products Directive into UK law. With it came a number of restrictions and obligations for both retailers and manufacturers of these products which will be laid out below, along with the work Liberty Flights is doing to maintain compliance.

Product Restrictions: The TRPR brought in a number of rules around what products could be sold and how they could be packaged and advertised:

What restrictions are in place?

As of 2017, The TRPR brought in a number of rules and regulations around what products could be sold and how they are packaged and advertised. TPD published the following guidlines to ensure e-cigarettes and refill containers are compliant with product safety.

  • E-cigarettes and tanks must have a capaciy of more than 2ml
  • A maximum strength of 20mg/ml is permited 
  • E-liquid bottles and refill containers must not be larger than 10ml
  • E-liquid bottles must be child resistant and tamper evident
  • Devices and e-liquid packaging must contain a warning covering 30% of the front and back with the text ‘This product contains nicotine which is a highly addictive substance’
  • Prohibition of certain ingredients: Certain ingredients are not permitted and are banned within e-cig products including colourings, caffeine and taurine
  • MHRA registration: Before any vaping products can be sold, they must be registered with the MHRA
  • Vape product companies cannot make health claims about the product

What's included?

Under TRPR all products that meet the requirements above and were on the market prior to 19th November 2016 needed to be notified to the Government. The notification contains information on the product brand, ingredients, emissions, delivery of nicotine and a sales data amongst other details about how and where it is produced. This allowed the product to continue to be manufactured and sold.

Products placed on the market after 19th November also need to complete this process but have to wait until the notification has been published by the Government before it can be manufactured and sold (up to 6 months).

The same applies to importers who bring product into the country and anyone in the supply chain that changes any element of the product, such as packaging.

As a responsible business and manufacturer Liberty Flights has complied with all requirements of the TRPR and notified a wide range of products to keep our customers satisfied and reassure them that they are buying from a reputable source.

Obligations For Retailers

As of 20th May 2017, all product being sold to consumers must be compliant with TRPR (product restrictions, notified to Government and published online). It is the responsibility of the retailer to ensure they are buying compliant stock from reputable businesses such as Liberty Flights. When a product is notified it is given a unique number called an ECID number. Suppliers should be able to provide this number for all their products, however this is not enough to guarantee compliance. All products must also appear on the published list found here.

Obligations For Consumers

As with any purchase it is advisable to purchase from a reputable source, therefore vapers know that the product is being sold legally and has met the safety standards laid out in the TRPR.

Don’t worry if you have a vape product bought before 20th May 2017 that does not meet the product requirements, it is not illegal to own or use any vape products.

Impact

The implementation of the TRPR has been a bumpy road for some but by staying ahead of the regulation and communicating with the various Government departments leading it, Liberty Flights has been able to complete the requirements in good time and will continue to work within the regulation.

As some products become no longer available there will be a change in landscape for vaping products however businesses such as Liberty Flights are working hard to keep the diversity within the market so vapers can find the best product to help them on their vaping journey.
